1 Validity of the GTC and conclusion of contract
1.1 These General Terms and Conditions (GTC) apply to purchase contracts with private customers and companies that are concluded via the provider’s website.
1.2 The order will be confirmed by Swiss Harmony. The contract is concluded as soon as the buyer receives the confirmation. If confirmation is not received within a reasonable period of time, the buyer shall consider this to be a rejection of the order and shall be entitled to conclude the contract with another supplier.
1.3 These GTC shall also apply to purchase contracts concluded by other means, e.g. by telephone, fax or letter. Customers are informed in the order confirmation where they can download the GTC on the Internet. If a customer does not agree with the GTC in such cases, he may withdraw from the purchase.
2. prices and price changes
2.1 Prices are quoted in CHF or Euro. VAT and processing fees are included. Shipping costs are charged separately, unless the products are offered as free shipping.
2.2 Swiss Harmony reserves the right to change prices at any time. The prices published on the website on the order date apply to customers.
3. terms of delivery and withdrawal
3.1 Delivery in Switzerland normally takes place within 2 working days, to other European countries within 3-4 working days. If a longer delivery period is necessary, the customer will be informed at the latest after this period has expired. If no information is provided, the customer is entitled to waive the delivery.
3.2 If a customer withdraws from the purchase due to late delivery or defects in the goods or other reasons for which Swiss Harmony is responsible, he will be refunded any amounts already paid as well as the return costs.
4 Liability and warranty
4.1 Swiss Harmony warrants for a period of 10 years that the goods have the warranted characteristics, that they are free from defects affecting their value or suitability for the intended use and that they comply with the prescribed performance and specifications.
4.2 The buyer must inspect the delivered goods as quickly as possible and report any defects immediately. The responsible customer service can be found at service@swissharmony.ch. Hidden defects can still be objected to even after the goods have been put into operation or used. The making of payments shall not be deemed a waiver of notice of defects.
4.3 If there is a defect, the buyer has the right to obtain a replacement delivery.

6. liability for online connections
6.1 Swiss Harmony undertakes to ensure state-of-the-art security in systems, programs, etc. that belong to it and over which it has influence, and to comply with the rules of data protection.
6.2 Customers must ensure the security of the systems, programs and data within their sphere of influence. In their own interest, customers should keep passwords and user names secret from third parties.
6.3 Swiss Harmony is not liable for defects and malfunctions for which it is not responsible, in particular not for security defects and operational failures of third-party companies with which it cooperates or on which it is dependent.
6.4 Furthermore, Swiss Harmony is not liable for force majeure, improper action and disregard of the risks on the part of the Customer or third parties, excessive use, unsuitable equipment of the Customer or third parties, extreme environmental influences, interventions by the Customer or disruptions by third parties that occur despite the necessary current safety precautions.
7 Application of law and place of jurisdiction
7.1 The court at the domicile or registered office of one of the parties shall have jurisdiction over any legal action brought by a customer. The court at the domicile of the defendant has jurisdiction for actions brought by Swiss Harmony.
