How should politicians deal with the current 5G debate? What does a ruling by the Münster Regional Court mean for landlords of mobile phone sites? And why is the term “technology-neutral” in the new Swiss Telecommunications Services Ordinance controversial?
The European Economic and Social Committee (EESC) comments on the current 5G debate and makes recommendations that suggest a political course correction. According to a recent report by theCompetence Initiative, the EESC notes that “the debate on the deployment of 5G networks has turned into a controversial political debate. Nevertheless, social, health and environmental issues must be clarified with the involvement of citizens and all relevant stakeholders.” The EESC calls on the European Commission to lead the way in assessing the impact of the new 5G and 6G technologies on the various sectors, as tools and measures are needed to manage risks and address vulnerabilities. The EESC therefore recommends “investing European and national resources in more in-depth multidisciplinary research and impact assessments that focus on people and the environment”. Their results should be made public so that the public and decision-makers are informed.
Monitoring and control
The EESC also proposes that the European Commission consult citizens and civil society organizations and contribute to the decision-making process with regard to the social and environmental impact of mobile electronic communications, involving all relevant public bodies. According to the EESC, the monitoring and control of electromagnetic pollution must be based on a stringent interinstitutional and interdisciplinary scientific approach. Although there is no recognized scientific data to support negative effects of 5G on human health, the EESC considers it appropriate to continuously monitor the social, health and environmental aspects of 5G in line with the precautionary principle. It also respects the concerns raised about health effects, including thermal and non-thermal effects, the intensity of exposure and the long-term effects of such radiation exposure.
Landlords of mobile phone sites are liable
According to a report by diagnose-funk.org, the District Court of Münster (Germany) has handed down a judgment that will make landlords of mobile phone sites sit up and take notice: According to the court, the latter can be held liable for EMF-related damage. The court confirms that not only the mobile phone system operator (as a so-called action disturber) is liable for damage caused by its system operation, but also the property owner (as a so-called status disturber) who makes his property available for system operation. In the event of damage, third parties can therefore assert liability claims against them in the same way as against the system operator. And because the local authority or municipality and its representatives could or should have known this, their action to terminate the tenancy agreement was dismissed. One thing is certain: Very few local authorities and landowners who rent or lease their land for the operation of mobile phone base stations are probably aware of their own liability risk.
Against “technological neutrality”
In Switzerland, the revision of the Telecommunications Services Ordinance (TSO) is just around the corner. Parties and associations can comment on this as part of the consultation process. The umbrella organization Elektrosmog Schweiz und Liechtenstein, for example, submitted its comments on the revision of the Telecommunications Services Ordinance (FDV) in a letter dated March 25, 2022. Instead of “technology neutrality”, it has spoken out in favor of the most environmentally and health-friendly technology in the regulation text. The aim is for the “principle of environmental and health compatibility” to be expressly stated in Art. 16 para. 1 FDV. “With the amendment to Art. 16 para. 1 FDV, the legislator wants to enshrine “technological neutrality” in law. This is linked to the idea or intention that telecommunications providers can require owners to connect their buildings, apartments and offices from the network termination point using mobile radio technology instead of cable in future,” argues the umbrella organization. Unfortunately, the term “technology-neutral” had already been used in the Telecommunications Act (TCA). However, this regulation is by no means considered “neutral” because it unilaterally promotes the more cost-effective wireless technology. At the time of the consultation on the TCA, the umbrella organization’s proposed amendment was not obviously taken into account.
Generate a harmonic oscillation field
