The Swiss Federal Criminal Court in Bellinzona handed down a ruling that comes at a politically charged time: it questions the quality and correctness of inspections of mobile phone installations. Schongau in the canton of Lucerne is a municipality with a pioneering spirit when it comes to the licensing of mobile phone antennas. The reasons for this decision are as follows: “The decision of the municipal building permit authority is based on the fact that the enforcement regulations for the use of “5G antennas” are not yet available and therefore there are no reliable technical guidelines. The federal government’s statement was not only published late, but was also recently actively postponed indefinitely. It is therefore unclear how the federal government and mobile network operators intend to derive a clear legal basis from this. The mobile phone providers themselves have been pointing out this problem for some time. The planning application is based on the Ordinance on Protection from Non-Ionizing Radiation (NISV), which is technology-neutral. This means that the provider would be able to use any technology without having to apply to the licensing authorities. The municipal licensing authority considers this practice to be unacceptable and is calling on the federal government to revise the ordinance accordingly. Federal Court casts doubt on correct control of mobile phone installations

At a politically explosive time
The Federal Criminal Court therefore wonders whether the data transmission was or still is faulty in other cantons as well. The last Switzerland-wide inspection was limited to the computer-controlled parameters and the information in the databases. However, the data transfer from the real plant to the QS scheme was not checked, according to the ruling. The next random checks should therefore be supplemented with on-site inspections of the systems. The Federal Criminal Court’s ruling comes at a politically explosive time, as mobile network operators are currently pushing for the nationwide rollout of 5G networks. They fear increased radiation and are slowing down construction with objections or cantonal moratoria.
